| This Contest is subject to the following terms and conditions and by participating in the Contest, all participants will be deemed to have accepted and agreed to be bound by these terms and conditions:
The Contest begins at 00:00:01 on 1st March 2007 and finishes at 23:59:59 on 1st May 2007 ("First Contest Period"), and continues from 00:00:01 on 1st July 2007 and finishes at 23:59:59 on 1st September 2007 (“Second Contest Period”) for selecting the Champion from the highest sellers in each tier. The Champion in the Second Contest Period shall be the highest seller (as determined by eBay) among the three (3) winners in each of the three (3) tiers from the First Contest Period.
Eligibility:
- the Contest is open to all eBay sellers who have registered their address in Singapore, Malaysia, the Philippines Thailand, Vietnam or Indonesia on eBay.
- Participants must be legal residents of these countries, 18 years of age or older ("Eligible Participant"). Eligibility is not transferable. You will not be eligible for the promotion if any of your eBay account is not in Good Standing. In order for your account to be deemed in Good Standing as that term is used herein, you must not have a hold on your account(s) and your account(s) must not be suspended, limited, or past due as of February 28th, 2007. Employees of eBay International A.G. ("eBay"), PayPal Private Limited ("PayPal"), and all their respective subsidiaries, affiliates, and their immediate families (spouse, parents, children, siblings and their respective spouses) and individuals living in the same household as such employees are ineligible.
How will the winners be chosen:
The winners will be the Southeast Asian sellers with the highest incremental GMV sold (within each Tier) from 1 March 2007 to 1 May 2007 on all eBay sites other than sites in Singapore, Philippines, Malaysia and Hong Kong. The incremental GMV calculation will be based on the past 2 months average GMV sold from January 2007 to February 2007. In calculating the incremental GMV, we assign a 70% weight to percentage of successful incremental listings and 30% on ASP (Average Selling Price). The calculation method used to determine the winners is at the sole discretion of eBay.
Contest Criteria and How Prizes Will Be Rewarded:
- For highest sellers from each tier (from the First Contest Period):
Participants can win trips to eBay Live! 2007 by achieving the highest points accumulated for each tier within the First Contest Period and/or highest growths in GMVs and/or high growth in weighted ranking of incremental Seller Listings and Average Selling Prices (as determined by eBay) in the First Contest Period
- For overall Champion (from the Second Contest Period):
The three (3) Winners from the First Contest Period will compete using the same criteria for the Second Contest Period. The Champion will win a *party to celebrate his/her win to be organized by the winner in the country of registration of the Champion, as well as USD$500 to be donated to a nominated charity in the same country. The Champion will also win a full scholarship to be an eBay Education Specialist.

Additional Requirements:
- All sellers must maintain up-to-date contact information on their eBay accounts.
- To be eligible for eBay prizes, participants will need an eBay account with a legitimate address in Singapore, Malaysia, the Philippines, Thailand, Vietnam or Indonesia.
- Includes Auction, fixed price (Buy it now), and Best Offers format on eBay.
- Stores inventory Format listings on eBay are included.
- Only items sold on eBay will be included for GMV, Listing and Average Selling Prices counts.
- Only 1 entry per participant, if you have more than 1 eBay account, linked accounts on eBay will be treated as 1 entry, and you will need to select 1 eBay account for participating in the Contest.
- Prizes not claimed will be forfeited, and any decision by eBay in the Contest shall be final and no correspondence will be entertained.
Limitation of Liability: eBay reminds entrants of the nature and limitations of the Internet and is not responsible for the sellers’ participation in the Contest, nor for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect entry to the Contest or reaching the specified targets.
- eBay shall not be liable, in contract or tort (including negligence) or breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the participant resulting directly or indirectly from this Contest, provided that nothing in these terms shall limit eBay's liability for death, personal injury or fraud. eBay is not responsible for printing or typographical errors in any contest and/or promotion related materials; for stolen, lost, late, misdirected prizes; or for transactions and/or emails that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with this Contest, or process any transaction thereon. If in eBay's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if computer virus, bugs, unauthorised intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, eBay reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, to modify or suspend the Contest, or to terminate the Contest. In all matters relating to the interpretation and application of any rule or phase of this Contest, the decision of eBay shall be final. eBay reserves the right to cancel, amend or revoke the Contest at any time due to reasonable business consideration or circumstances beyond its control. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, eBay reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any web site associated with this Contest via a bot script or other brute force attack or any other unauthorised means will result in the IP address becoming ineligible. Use of automated entry devices or programs is prohibited.

No Combination or Transfer of Promotional Offer. This contest/promotional offer cannot be resold, transferred, or combined with any other offer, discount, or promotion. No cash alternatives will be substituted for the stated prizes and no alternative prizes will be offered.
Governing Law. These Official Terms and Conditions shall be interpreted, construed and enforced in all aspects in accordance with the laws of Singapore and all participants hereby submit to the non-exclusive jurisdiction of the courts of Singapore.
Promoters. The promoters of the Contest are eBay International AG, who may carry out this Contest through its local subsidiaries (“eBay”).
