1.

Information about the prizes and how to enter forms part of these Terms and Conditions for the eBay Singapore “Guess the Price” Contest (Promotion).  Entry into the Promotion is deemed acceptance of these Terms and Conditions.  Entries not in accordance with these Terms and Conditions are ineligible.
   

2.

Entry is open to all residents of Singapore over the age of 18 years.  Employees of the Promoter, its associated companies, suppliers, distributors, agents and their immediate family members, and persons whose account with eBay have been temporarily or indefinitely suspended or made inactive by the Promoter (as defined in clause 31) during the Promotion Period (as defined in clause 9), are not eligible to enter the Promotion.

Entrants are responsible for ensuring that all their contact details registered with or submitted to the Promoter are correct.  Entrants will forfeit their right to claim the Prize (as defined in clause 16) in the event that their contact details are inaccurate or wrong.  Members of eBay may check or update their contact information with eBay by visiting the Personal Information section of My eBay at https://www.ebay.com.sg.

To qualify for entry into this Promotion, you must at the time of entry be validly registered as a member of https://www.ebay.com.sg (in accordance with all applicable terms and conditions, policies and your User Agreement with eBay).
   
 
5.

To enter this Promotion, prior to the end of the Promotion Period you must:

a)
 login to your eBay user account at https://www.ebay.com.sg;
b)
 visit https://www.ebay.com.sg/gss/guesstheprice and guess the right selling price of the featured “Guess The Price” item by submitting your guess via the electronic form therein.

You can submit as many price guesses as you wish; however your last price guess will override all your previous guesses in respect of the same “Guess The Price” item and only that last submission will be considered as your entry.
   

7.

Each eBay member will only be entitled to win one (1) Prize per during the Promotion Period.
   
8. All eBay members must conform to eBay’s policies and user agreements applicable during the Promotion Period.
   
 

9.

 This Promotion commences at 00:00:01 Singapore Time, i.e. GMT + 8 hours (SGT) on 16 June 2008 and closes on 23:59:59 SGT on 13 July 2008 (Promotion Period). 
   

10.

 During each week of the Promotion Period, there will be 1 featured “Guess The Price” item.  There will be four (4) featured “Guess The Price” items in total across the four (4) weeks that constitute the Promotion Period.
   

11.

 All entries submitted for each relevant week of this Promotion must be received by 23:59:59 GST on Saturday, such day being deemed the last day of that week.
   
 
12. Each week, the participant whose guess in respect of that week’s featured “Guess The Price” item is the closest match to the average selling price of a similar item sold during that same week on https://www.ebay.com.sg shall be deemed the winner for that week (Winner). 
   
13. If more than one participant submits a correct guess, the Winner will be the participant who submitted the earliest correct guess.
   
14. The selection of the Winners shall be at the Promoter’s sole discretion.
   
15. There will be only one (1) Winner each week and four (4) Winners in this Promotion in total.
   
   
16.

The prize that will be awarded to the Winner (Prize) for each week during the Promotion Period will be the same item as the featured “Guess The Price” item for that week. 

   
17.

The Promoter shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of the Prize or for any defect or malfunction in the Prize. The acceptance of the Prize by the Winner shall be on a strict “as-is” basis only.
   
18. The Promoter retains the right to substitute the Prize with a prize of equal or greater value, subject to any approvals necessary.
   
19. No costs or expenses, other than those expressly set out in these Terms and Conditions will be included in the Prize and all costs and expenses other than those expressly included within the Prize in these Terms and Conditions are the responsibility of the Winner.
   
20. The Prize is not transferable or exchangeable.
   
   
21. The Promoter will notify the Winner within 14 days of the end of the Promotion Period through the telephone number listed in their eBay registration details (if possible) or by email.
   
22. Upon making successful contact with the Winner, the Promoter will arrange with the Winner for the Winner to collect the Prize within the requested time from the eBay Southeast Asia office at 89 Neil Road, #03-01, Singapore 088849.
   
23. If the Promoter is unable to successfully contact the Winner or the Winner does not accept the Prize within the time frame stipulated in clause 21 after a further 3 days of trying to contact that Winner, then that Winner will be deemed to have forfeited the Prize and the Prize will be awarded to the next best entry, and that entrant will be deemed to be the new Winner. The Promoter will attempt to make contact the new Winner in a similar fashion, and will carry on this process until either a Winner can be successfully contacted and declared.
   
24. Within 3 days of successfully contacting the Winner, the Winner’s first initial, surname and truncated form of username (e.g. a**b) will also be published on the announcement board of https://www.ebay.com.sg. 
   
   
25. All entries are the property of the Promoter.  All personal information will be held and dealt with in accordance with the Privacy Policy of the Promoter which is available on the eBay website (https://pages.ebay.com.sg/help/policies/privacy-policy.html).
   
26. Each entrant consents to the Promoter and its agents collecting the information provided in their entry in order to conduct the Promotion.  Neither the Promoter nor its agents will use the information collected in the course of the Promotion for any marketing purposes, other than in connection with the Promotion.  An entrant may access and correct any personal information held by the Promoter in relation to that entrant, upon request to the Promoter.
   
   
27. The Promoter’s decisions with regard to the selection of the Winners are final, and no correspondence will be entered into, including in the event of a dispute.
   
28. The Promoter is not liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with participating in this Promotion or receiving, taking or using the Prize, except for any liability which cannot be excluded by law.  Any tax liability arising as a result of receiving, taking or using the Prize is the responsibility of the Winner.
   
29. Entries are deemed to be received at the time of receipt into the Promoter's database.  The Promoter is not responsible for entries not received or the receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission.  The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, lines, servers, telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person's handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
   
30. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its sole discretion to modify the terms of the Promotion including the Prize and these Terms and Conditions, subject to approval from any relevant regulatory authorities.
